I don't know what's funnier. This guy screeching about getting sued by Jeremy Bernal, or the horrendously bad legal advice that follows. I really hope for the defendant's sake that he's smart enough to see a lawyer and get proper legal advice before doing anything stupid. (such as say, not showing up, as others have suggested)

No matter what happens, I smell a train wreck in the making.

The thing is, it didn't have to get this far. He could have complied with the very fisrt DCMA notice that Barnal sent him. But no, he decided to post it and insult Barnal (http://www.pleasedontsue.com/wtfur/view.php?id=6) instead.

Bernal is suing, because a counter-DMCA was filed stating that whilst we took them down, we felt we didn't have to. This gave him the option to sue. And sue he is, for 'inestimable monetary damages'. In other words, he hasn't lost any money, he can't prove he lost any money, but he's going to pretend he has in an attempt to ruin someone.

It reminds me of the BRILLIANT actions the mother of a fellow who was being delt with for injuring my husband in a car. She was.. "helpful" and said when his lawyer called that her son wasn't there to speak to her because he was in jail, and anyway wasn't driving the car but had lent it out with his licence to someone else, so it wasn't his fault at all. XD
The entirety of the deposition hearing was the two insurance companies asking Kyle for a good discription of the people driving the car, and planning their insurance fraud case ;D

FYI for anyone reading this, this is NOT me

Just so people know, I'm not involved in this. My name is Arcturax ("ax" at the end, not "us") and yet people continually confuse me with the person signed on the pleasedontsue site which was Arcturus.

I get confused with this guy all the time by people and it gets really irritating, especially since I've been using the name Arcturax for myself since the 1980's (though not online till 1996 or so).

OK first off, this whole thing is a little confusing so here's some of the stuff I've come up with.

1. Arcturus is a fur in the UK (last I knew) who was part of the team that started furaffinity (left due to drama) and then tried to create chanplz a site which wouldn't accept take down notices. When the fur community almost tore him to pieces bodily, he finally took the site down. So if this IS his work, then this is par for the course for him.

2. The guy who is crying about being sued claimes to live in Ohio. I live in Ohio and that plus Arcturus' name is why some people might be thinking this was me. It was not, I knew nothing of the site and have nothing to do with it nor with Arcturus.

3. The whois info on the site points to someone in new york, but I think it is almost certainly fake information. It is possible that someone signed Arcturus' name on there to try to throw anyone who did try to sue off, but then again who knows. I am curious as to if Arcturus really is behind this. I did used to be aquianted with him but I don't talk with him any more (mainly due to his recent behavior).

I dunno how all that fits together, but there you have it. If someone else wants to slueth more out of this mess, I hope this information helps.

Well I hadn't directly dealt with him in like 6 months or more anyway. He was never really so much a friend as an aquaintance I had dealt with only a handfull of times on Alfandria MUCK long ago. I was never really involved in any of the drama he created. I saw your warnings, but I tend to judge personal experience with people. But I did see him going downhill but more from a distance. I just didn't get around to removing him from my LJ list until recently but hell, I hadn't spoken with him in a full year anyway.
